Charleston, W.Va. (AP) -- The Chief Justice of the West Virginia Supreme Court is frustrated with what he calls a significant lack of resources at the state agency in charge of health care.
In an opinion published last week, Chief Justice Brent Benjamin wrote the problem has resulted in situations where the Department of Health and Human Resources fails to comply with some of its legal obligations.
Benjamin wrote that the underlying problem at the agency may require the Supreme Court's attention, although he didn't specify what that might mean.
DHHR spokesman John Law says the agency does have problems with resources, especially in terms of competing with the private sector to hire employees.
