W.Va. County Charges Bars For Re-Inspections

Charleston, W.Va. (AP) -- The standoff between health officials in West Virginia's largest county and a bar owner who flagrantly violates a smoking ban is coming to a head.

Blackhawk Saloon Kerry "Paco" Ellison says he won't pay two invoices for a total of $175 for health inspections at his bar. Instead, Ellison says he plans to use them as wallpaper.

Kanawha-Charleston Health Department environmental director Anita Ray says that if Ellison doesn't pay,

Blackhawk will lose its health permit, followed by its liquor license.

Since the county banned smoking in bars and other public places, Ellison has encouraged patrons to smoke and sponsored several smokers' nights at the Blackhawk Saloon.

The health department has given Ellison until Sept. 27 to pay the inspection bills.

    The owner of the saloon is perfectly RIGHT but we all know being right don't mean you win. I beleive when you own a house, business, car, etc. - it should be your decision what to allow to go on and if other people don't like it, well they should go away.

    Actually - the bar owner is right although outside of the law it seems unless he can prove it's a RULE and not a law. I beleieve folks in the US who owns businesses should decide if they want smokers or non smokers - not too many folks stand in line to file suit for not being hired in honkey tonk up a hollow due to the fact they won't tolerate smoking haha. FDA has known many years how harmful cig smoking is - but they let the tobacco companies get rich and want to shut down the poor little businessman now !!!. They need to concentrate on the drugs that kill or cause addicts to kill/harm others and let grown adults decide about what to put in their body They have court hearings by video - they could investigate the bars by suprise video means if they are concerned about cleanliness etc - they don't need to send a non smoker in to inspect and have them complain about the darn smoke.
