WVa ABCA Faulted Again For Fine Disparities

Charleston, W.Va. (AP) -- West Virginia's alcohol regulators have again been faulted for inconsistent fines against bars and clubs caught serving underage patrons.

But the Alcohol Beverage Control Administration believes that a fixed penalty schedule will leave it unable to resolve violations on a case-by-case basis.

Legislative auditors reviewed some $316,474 in fines collected by the agency between July 2005 and December 2007.

They reported to lawmakers tuesday that of a sample of 29 first offenders caught serving minors, 18 were fined $150 while 10 were hit for $500.

The remaining fine was for $100.

Three previous audits found similar issues.

But agency officials maintain that the facts behind any given violation don't fit neatly into a chart.
