Charleston, W.Va. (AP) -- The Kanawha County Board of Education is dropping random drug testing of employees after learning that the new policy likely won't withstand a court challenge.

Board members voted 5-0 Monday to end the policy.

The American Federation of Teachers-West Virginia filed a federal lawsuit challenging the policy in November.

The union argues that the policy is illegal and unnecessary.

In December, a federal judge halted the policy's implementation until a final ruling was made in the lawsuit.

School board members cited the expense of fighting the lawsuit. Member Pete Thaw says the board was told by its attorneys that it had "little or no chance" of winning the case.
