A felony charge against an Ohio DNR officer has been dismissed but it is reportedly on the list of considerations for grand jury.
Washington County Prosecutor Jim Schneider said the felony charge against Charles Stone has been dismissed but not thrown out. Court records show the case was dismissed May 25.
The fifth degree felony charge is in connection to Stone's arrest in Belpre last month for allegedly driving under the influence while having a loaded handgun in the vehicle.
Schneider said since the felony charge involving the handgun has been dismissed there will not be a preliminary hearing on the case but it is on the list of considerations for grand jury.
Stone's attorney filed an automatic license suspension appeal on the OVI (operating vehicle under the influence of alcohol) charge. Stone will appear in court June 16 for a hearing related to the appeal.

An Ohio Department of Natural Resources officer is finding himself on the other side of the law, making his first court appearance Monday morning.
48-year-old Charles Stone was in Marietta Municipal Court, facing a felony charge of the 5th degree in connection with driving under the influence while having a loaded handgun in the vehicle.
Stone's arraignment was continued until next Monday; allowing him time to speak with an attorney.
The court is also awaiting Stone's alcohol test results.
No decisions have yet been made with the DNR concerning his future employment.
According to Ohio Highway Patrol, an Ohio DNR law enforcement officer has been arrested for allegedly driving drunk while also reportedly having a hand gun inside the vehicle.
A Highway Patrol officer said early Saturday morning Charles Stone was pulled over on State Route 7 near Braun Road in Belpre for a traffic violation.
The 48-year-old was subsequently arrested for operating a vehicle under the influence.
A Highway Patrol officer said officers also seized a personal 9 mm semiautomatic handgun. Officers confirm the handgun was inside the vehicle.
Charges related to the handgun are pending.
Officers are awaiting alcohol test results.
Stone is scheduled to appear in Marietta Municipal Court Monday morning.
