Former Deputy Still Has Suit Against Ex-Sheriff

Two former law enforcement officials face off in court. Former Wood County Deputy Jim Asbury's lawsuit against former Wood County Sheriff Jeff Sandy will proceed.

Monday afternoon Wood County Circuit Judge Robert Waters denied a motion to dismiss Asbury's amended complaint.

Asbury filed a lawsuit saying his dismissal three years ago by then-Sheriff Jeff Sandy was politically motivated.

Judge Waters recently denied a previous motion to dismiss the suit, but gave Asbury's attorney time to amend his complaint.

Asbury was dismissed from the department after an accident involving a sheriff's cruiser -- an incident which also figured in an unsuccessful attempt by another former deputy to have Sandy removed from office.
