WESTERVILLE, Ohio (AP) - Authorities say a motorist who served nearly eight years in prison and lost his license after killing an Ohio trooper while driving drunk has been charged with driving under suspension and having an open mixed drink in the vehicle.

Genoa Township police say 43-year-old David Dye of Westerville had not been drinking when arrested Saturday, telling police he was going to watch the Ohio State game.

He was freed Monday on $20,000 bond. A phone message seeking comment was not immediately returned.

Twenty-six-year-old trooper Frank Vazquez of Marysville was killed in 2001 on a Columbus highway as he gave another motorist a ticket. Dye had pleaded no contest to vehicular homicide and drunken driving, marking his fifth drunken driving conviction.

Police say he had been released from parole in January.
