WV Senate Panel Gives Magistrates DUI Licensure Cases

Charleston, W.Va. (AP) -- The Senate Judiciary Committee wants county magistrates to decide whether a person charged with drunken driving should have their license revoked or suspended.

Hearing examiners within the division of motor vehicles now preside over the administrative side of dui cases.

But the agency has been rocked by evidence of abusive practices.

Commissioner Joe Miller was brought in to clean up that mess.

He told the committee that he's confirmed some allegations that defendants were not treated fairly in these dui hearings.

Miller is backing the bill that the committee endorsed Friday.

It would allow magistrates to decide both the criminal and civil sides of a dui case at the same time.

It now goes to the full senate for a vote.

    I work at a bank drive thru and you would not believe the people that come thru driving on an ID only. Wonder who they have insurance thru!

    not really sure if that will serve any justice for anyone. the driver with or without there DL is going to drive!!! do something to let these drivers know that a driving drunk will get more then just a fine and revoked DL.

    As a ploice officer I like this idea if the magistrates are fair and equal. I'm fearful some will be suspended and some will not under the same circumstances. It would be easier to just say that if you are found guilty ( or cop to a chicken sh*@ plea) then you are suspended automatically found not guilty then no suspension. This will be used as a plea bargaining tool and it shouldnt be.
