Lawsuit Filed In W.Va. Wreck That Killed 5

Morgantown, W.Va. (AP) -- The families of five people killed in a fiery 2007 crash are suing a convicted drunken driver and two bars that served him for negligence and wrongful death.

A lawsuit filed in Monongalia County Circuit Court names Brian Stone, Automatic Slim's Hot Spot and Novichenk's Tailgater's Pub 2 as defendants.

Calls to Novichenk's and the Hot Spot owner went unanswered Tuesday.

The complaint says bar employees knew or should have known Stone was already impaired when they served him the night of the crash.

Police say his blood alcohol content was nearly three times the legal limit.

Stone was convicted in 2008 of 25 charges, including five counts of DUI causing death. He was sentenced to up to 56 years in prison.

    Nothing can ever make up for the loss these families experienced. When loved ones are taken from us because of others' negligent behavior, then I say SUE. I will totally admitt that there are crap lawsuits everyday in this country, but this is not one. If suing will help these families in any way, I say sue, sue, sue!!!!

    I agree with them suing the bar owners. I bartended for a short while and i always knew when the people i served drinks to had had enough. Even those who just walked in and ordered, you can always tell if they've had too many. We were taught to keep an eye out for people who had had too much, we were told to cut them off. Our owners were strict with that rule.. I do believe the bar owners and workers should be held accountable with a nice stiff fine and a small amount of time in jail. Especially if the accused was a regular patron and they knew him well, therefore they would know how impaired he was when he left the bar.

    The crappy thing about it is , that 5 people were killed because of ONE drunk driver.5 peopls lives were lost because a FOOLISH drunk was behind the wheel of a vehicle and cause 5 INNOCENT people to loose there lives. Now tell me what is worse a law suit or the death of the innocent people caused by a very irresponsible and careless drunk.
