Lebanon, Ohio (AP) -- A legal path has been cleared for the retrial of an Ohio man charged in the bathtub drowning of his wife.
Warren County prosecutor Rachel Hutzel says she decided not to pursue further appeals of a judge's order that Ryan Widmer receive a new trial because of juror misconduct.
Hutzel says she wanted to spare the family of 24-year-old Sarah Widmer the extra waiting that would come with taking the case to the Ohio Supreme Court.
Attorneys for Ryan Widmer responded that Hutzel had a weak case for appeal.
Judge Neal Bronson will set a new trial date later. He earlier ruled that Widmer's right to a fair trial was violated when jurors conducted experiments at home before convicting him of murder in April.
The 28-year-old man is free on bond.
