MORGANTOWN, W.Va. (AP) - A judge has thrown out a gas company's lawsuit against the Doddridge County Commission, saying he has no jurisdiction to hear the fight over a flood plain ordinance that he's determined is unconstitutional.
Pittsburgh-based EQT sued the county for revoking a flood plain permit after it spent $300,000 on the permitting process.
But the county acted after it realized homes and livestock were vulnerable.
EQT asked Circuit Court Judge Timothy Sweeney to issue an injunction on the revocation so it could proceed with plans for 12 wells. But Sweeney denied that and EQT's motion for summary judgment.
Spokeswoman Linda Robertson said Wednesday that EQT is reviewing the ruling and its options. She says the commission is working on a new ordinance that EQT will want to study before doing anything.
