UPDATE: Man gets 24 years in prison for role in fatal Athens shooting

ATHENS, Ohio (WTAP) - UPDATE: 12/11/18 5:30 P.M.

Robert Andrew Martin, 26 of Glouster, Ohio, Troy Allen Vermillion II, 28, Bernard C. Mitchell, 23, and Michael Allen Russell, 20, all of Athens, Ohio, were indicted on Dec. 5, 2018 on felony charges in the Nov. 25, 2018 murder of Charles Duncan Sr. in Athens.

The second of five men charged following an investigation into the shooting death of an Athens man in November was sentenced to prison on Tuesday, prosecutors said.

Bernard C. Mitchell, 23, of Athens, received a 24-year sentenced and five years of post-release control after being found guilty of numerous charges in Athens County Common Pleas Court. Those charges include involuntary manslaughter, aggravated robbery, robbery, engaging in a pattern of corrupt activity, having weapons while under disability, breaking and entering, grand theft and burglary.

Charles Duncan Sr., 55, was found dead from gunshot wounds on Nov. 25 after Athens police responded to a reported shooting at his apartment at 221 West Washington St.

A grand jury indicted Mitchell and three other men - Robert A. Martin, 26, of Glouster; Troy A. Vermillion II, 28, of Athens; and Michael A. Russell, 20, of Athens – on numerous charges on Dec. 5. All three are scheduled to be arraigned on Wednesday. They remain in the Southeast Ohio Regional Jail.

Another man, Jonathon C. McLaughlin, 23, of Glouster, was sentenced on Dec. 4 to 18 years in prison for his role in the cases, prosecutors said in a news release.

Four men were each indicted Wednesday in Athens County Court on multiple felony charges in the murder of Charles Duncan Sr. in Athens.

Duncan Sr. was found dead from gunshot wounds on Sunday, Nov. 25, 2018, when Athens Police officers responded to a reported shooting at his apartment at 221 West Washington Street.

Michael Allen Russell, 20, of Athens, Ohio, was indicted for:
Count 1: Having Weapons While Under Disability, a felony of the third degree
Count 2: Murder, an unspecified felony
Count 3: Involuntary Manslaughter, a felony of the first degree
Count 4: Aggravated Robbery, a felony of the first degree
Count 5: Robbery, a felony of the second degree
Count 6: Receiving Stolen Property, a felony of the fourth degree

Prosecutors say all four men, along with Jonathon McLaughlin, were allegedly involved in a methamphetamine tracking ring that accepted stolen property as payment for the drugs, and they also broke into homes and businesses to steal items themselves.

Athens Police say the men went to Duncan Sr.'s apartment on Sunday, November 25, 2018 and fired gunshots through the front door, with some of those bullets hitting and killing Duncan Sr.

McLaughlin was previously indicted on multiple charges in this case and was sentenced on Dec. 4, 2018 to serve 18 years in prison.

Martin, Vermillion, Mitchell and Russell will be held at the Southeast Ohio Regional Jail until their arraignments, scheduled for Dec. 12, 2018 in the Athens County Court of Common Pleas.

This case was investigated by the Athens Police Department, Ohio Bureau of Criminal Investigation, Athens County Sheriff’s Office, Athens Major Crimes Unit, Glouster Police Department and the Athens County Prosecutor’s Office.


UPDATE 11/28/2018, 3:06 A.M.

Michael Russell is currently being held at the Southeastern Regional Jail, where he was booked just before midnight, Tuesday night.

Russell is facing two charges of involuntary manslaughter and robbery.

His bond is set at $75,055 for both charges.

Athens Police say a man wanted for reportedly shooting and killing another man turns himself in.

Michael Russell he was taken into custody around 6:43 p.m. Tuesday.

He called 911 and said he was at The Plains McDonalds.

He was taken to the Athens Police Department for questioning. He'll be held at the Southeastern Regional Jail for arraignment at 8:30 a.m. Wednesday.

He reportedly shot and killed Charles Duncan Senior Sunday on West Washington Street.

Athens Police have identified a man who was fatally shot Sunday in an apartment on West Washington Street, and an arrest warrant has been issued for a suspect.

Charles Duncan Sr., 55, was found dead inside his apartment at 221 West Washington St. on Sunday morning after officers responded to a reported shooting there, Athens police said.

Michael Allen Russell, 18, of Pleasanton Road in Athens, is being sought on felony robbery and involuntary manslaughter charges.

Police said he should be considered armed and dangerous.

Athens Police find the body of a man in an apartment in Athens Sunday morning.

The department says it was called to a report of a shooting at an apartment located at 221 West Washington Street.

Police found a 55-year-old man with a fatal gunshot wound.

The victim’s identity will be released once the family is notified.

Athens Police received assistance at the scene from the Ohio University Police Department, Athens County Sheriff’s Office, Athens County Emergency Medical Services, The Athens County Coroner’s Office, and The Ohio Attorney General’s Office BCI&I. Athens Police continue to investigate this incident.
